1. Acceptance of Terms
By accessing or using the BricksAbove Inc ("BricksAbove") platform at bricksabove.com and related services (the "Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service.
2. Description of Service
BricksAbove is a property management software platform that enables landlords and property managers to manage rental properties, process tenant applications, collect rent, handle maintenance requests, generate financial reports, and communicate with tenants. We also provide a tenant portal for tenants to pay rent, submit maintenance requests, and manage their tenancy.
3. Account Registration
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
4. User Responsibilities
As a user of the Service, you agree to:
- Use the Service only for lawful purposes and in compliance with all applicable Canadian federal, provincial, and municipal laws
- Provide accurate information in rental applications, listings, and communications
- Respect the privacy and rights of other users, including landlords and tenants
- Not use the Service to discriminate against any person in violation of human rights legislation
- Not attempt to gain unauthorized access to other accounts or systems
- Not use automated systems or bots to access the Service without our permission
- Not upload malicious code, viruses, or harmful content
5. Landlord Responsibilities
Landlords and property managers using BricksAbove agree to:
- Comply with all applicable residential tenancy legislation in their province or territory
- Use tenant screening features in accordance with privacy laws and human rights codes
- Provide accurate property and unit information
- Handle security deposits and rent payments in accordance with local laws
- Maintain properties in compliance with health and safety standards
6. Tenant Responsibilities
Tenants using the BricksAbove portal agree to:
- Provide truthful information in rental applications
- Pay rent on time through the designated payment methods
- Submit maintenance requests in good faith with accurate descriptions
- Comply with the terms of their lease agreement
7. Payments and Fees
BricksAbove may charge subscription fees for use of the platform. Fee details are available on our pricing page. All fees are in Canadian dollars unless otherwise stated. We reserve the right to change our pricing with 30 days' notice. Rent payments processed through the platform are subject to payment processor terms and fees.
8. Intellectual Property
The Service, including its design, features, content, and underlying technology, is owned by BricksAbove Inc and protected by Canadian and international intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform without our written consent.
9. Content and Data
You retain ownership of the content you upload to the Service (documents, photos, communications). By using the Service, you grant BricksAbove a limited license to store, process, and display your content as necessary to provide the Service. We will not use your content for purposes unrelated to the Service without your consent.
10. Limitation of Liability
BricksAbove provides the Service "as is" and "as available." To the maximum extent permitted by Canadian law, we disclaim all warranties, express or implied. BricksAbove shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.
BricksAbove is a software platform and does not provide legal, financial, or real estate advice. Landlords and tenants are responsible for ensuring their actions comply with applicable laws.
11. Indemnification
You agree to indemnify and hold harmless BricksAbove Inc, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. You may cancel your account at any time. Upon termination, your right to use the Service ceases, though certain provisions of these Terms will survive termination.
13. Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if necessary, through the courts of competent jurisdiction in Ontario, Canada.
14. Changes to These Terms
We may update these Terms from time to time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
